Steps To Take If You Suspect Elder Abuse, Including When To Talk To An Attorney

Understanding and Addressing Elder Abuse in Nursing Facilities

Family members often find themselves paralyzed with hesitation when they suspect a loved one is experiencing elder abuse or neglect within a nursing facility or long-term care home. It’s common to second-guess whether emotions are clouding judgment, fearing that raising concerns might antagonize staff or make conditions worse for the elder. This reluctance, while understandable, can unfortunately allow harmful situations to escalate unchecked.

In reality, elder abuse and neglect can develop rapidly. What might initially appear as a minor oversight or isolated incident can transform into a dangerous pattern of mistreatment or neglect. Early intervention is crucial not only to protect vulnerable loved ones but also to preserve vital evidence that holds negligent facilities accountable for their actions.

Barry A. Drucker, an experienced attorney specializing in elder law and personal injury, emphasizes this point: “Elder abuse cases often begin with a simple feeling that something is wrong. A fall happens after staff promised supervision. Or the elder’s weight drops quickly. Sometimes, such declines are related to underlying illnesses. But other times, it’s because staff isn’t performing as they should. Following up on suspicions is critical for ensuring elders are safe.”

Drucker’s career has centered on advocating for personal injury victims and, more specifically, for older adults harmed by neglect or abuse in care settings. His background—ranging from chairing the Roxbury Park Seniors Legal Clinic to representing vulnerable elders—underscores his commitment to fighting large insurance companies and care facilities that fail their duties. He understands the subtle ways older adults can be dismissed or exploited and works to restore their dignity, safety, and respect.

“If you suspect elder abuse, start with safety,” Drucker advises. “Once you’re sure your loved one isn’t in a dangerous situation, then you can move forward with addressing the situation, which might require getting an attorney involved.”

Immediate Steps: Prioritizing Emergency Care

When abuse or neglect poses an urgent threat to an elder’s health, the first and most important step is to seek emergency care immediately. Calling 911 is essential if the situation involves serious injuries or an immediate risk to life or safety.

Drucker stresses, “Don’t wait for a care-plan meeting, a callback from the facility, or a written complaint process if your elderly loved one is in immediate danger. Call 911, clearly explain that the situation involves an older adult, describe the risk, and give the facility’s name and address.”

Examples of emergencies include head trauma, bone fractures, breathing difficulties, overdose, or severe dehydration. Additionally, physical assault, sexual abuse, threats, or active intimidation must be treated as emergencies warranting prompt intervention.

“If the facility is delaying necessary medical treatment, family members should immediately call 911,” Drucker adds. “The same applies if a staff member or another resident has created an immediate safety risk that the facility isn’t addressing.”

The Importance of Documentation in Elder Abuse Cases

Accurate and thorough documentation is vital when suspecting elder abuse or neglect. Family members should record key details such as the date and time of incidents or observations, the name of the facility and specific room number, visible injuries, and the state of the elder’s living area. Information about staff members involved, any witnesses, supervisors, and any explanations or responses provided by the facility should also be noted.

“Documentation is especially important because nursing homes or other facilities may later claim the family misunderstood the situation, the injury was unavoidable, or that caregivers handled the problem properly,” Drucker explains. “Taking photos or videos—when lawful and appropriate—of bruises, bedsores, dirty bedding, medication packaging, and unsafe room conditions can be invaluable. Families should also save text messages, emails, voicemails, incident reports, and complaint confirmations.”

When to Consult an Elder Abuse Attorney

Assisted living and skilled nursing facilities are legally required to uphold standards of reasonable care. When these standards are not met, ensuring that abuse or neglect is properly addressed often requires the expertise of an attorney who specializes in elder abuse cases.

“Reporting to agencies like Adult Protective Services or care crisis lines can initiate investigations and help stop ongoing harm,” Drucker notes. “However, these measures alone may not secure compensation for the injured elder or their family. In cases where neglect, abuse, or exploitation has caused injury, decline, hospitalization, or death, a civil elder abuse claim may be necessary.”

An elder abuse lawyer plays a critical role by reviewing medical and facility records, preserving evidence, investigating prior violations, and consulting expert witnesses. Their work helps determine if the facility breached its duty of care and caused harm.

“Not every complaint about care quality justifies a lawsuit,” Drucker clarifies. “Elder abuse claims require proof that the facility owed a duty of care, failed to meet that duty, and directly harmed the resident. Elder abuse attorneys provide the legal guidance needed to confirm abuse and hold negligent facilities accountable.”
